Welcome to WINDMILL. These Terms of Service ("Terms") govern your access to and use of our platform, including membership, events, and related services. By accessing windmillpassport.com or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our platform.

1. Membership Overview

1.1 Subscription Terms

  • Price: €300 per year (exclusive of applicable taxes)
  • Renewal: Your membership automatically renews every 12 months unless cancelled
  • Billing: You will be charged on your renewal date. You will receive an invoice and advance notice before each renewal.

1.2 Cancellation & Refunds

  • Cancellation: You can cancel your membership anytime from your account settings or by contacting support@windmillpassport.com
  • Access After Cancellation: You retain access to membership benefits until your current billing period ends. Cancellation takes effect at the end of your current membership year, not immediately.
  • No Refunds: We do not offer refunds for any portion of your membership fee. Cancellation does not entitle you to a refund for the remaining period.

2. Account & Eligibility

2.1 Account Registration

To use WINDMILL, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your password
  • All activity under your account
  • Notifying us of unauthorized access

2.2 Age & Eligibility

  • You must be at least 18 years old to use WINDMILL
  • You must be a legal resident of the jurisdiction where you access the platform

2.3 Identity Verification (KYC)

To activate your membership and access events, you must complete identity verification ("KYC") through our partner Veriff:

  • Requirement: KYC is mandatory before accessing any events
  • Process: You will provide a valid identity document (passport, national ID, or driver's license) and a facial scan
  • Verification Time: Verification typically completes within 24 hours
  • Declined Verification: If verification fails, we will notify you of the reason. You may resubmit using a different document.
  • Re-verification: You may be asked to re-verify periodically for compliance reasons

3. Membership Benefits & Access

3.1 What's Included

Your annual membership includes:

  • Access to all WINDMILL curated events
  • Exclusive venue partnerships and experiences
  • Ability to RSVP to events with a personalized pass
  • Ability to invite one guest per event (guest fees apply)
  • Priority booking for capacity-limited events

3.2 Event Access & Capacity

  • RSVP Required: You must RSVP to an event to attend. No RSVP = no access.
  • Capacity Limits: Events have limited capacity. RSVPs are on a first-come, first-served basis.
  • Pass Requirements: You will receive a personalized pass with a QR code upon RSVP. Show this at entry. One pass per person.
  • Non-Transferable: Your membership and passes are personal to you and cannot be transferred, sold, or shared.

3.3 Guest Passes

  • Guest Policy: You may bring up to one guest per event
  • Guest Fee: €100 per guest per event (paid separately from membership)
  • Guest Pass: Your guest receives their own QR code pass. They must present it at entry. Without it, entry is denied.
  • Guest Cancellation: You can cancel a guest invite up to 24 hours before the event for a full refund.

4. Payment & Billing

4.1 Payment Processing

  • Processor: Payments are processed by 2Checkout (a PCI-DSS compliant payment platform)
  • Currency: Pricing in EUR. Taxes and fees may apply based on your location.
  • Payment Method: Credit/debit cards accepted

4.2 Billing Issues

  • If a renewal payment fails, we will attempt to charge your card again
  • If payment continues to fail, your membership will be suspended until payment is resolved
  • You are responsible for keeping your payment information current

5. Conduct & Community Standards

5.1 Prohibited Conduct

You agree not to:

  • Violate any laws or regulations
  • Share your account credentials or allow others to use your account
  • Engage in harassment, discrimination, or abusive behavior
  • Attempt to gain unauthorized access to WINDMILL systems
  • Collect or scrape user data
  • Use the platform for commercial purposes without permission
  • Disrupt events, venues, or other members' experiences
  • Engage in illegal activities or substance abuse at events

5.2 Violations & Suspension

WINDMILL reserves the right to suspend or terminate your membership immediately if you:

  • Violate these Terms
  • Engage in prohibited conduct
  • Pose a safety risk to other members or venue staff
  • Misrepresent your identity during KYC
  • Use the platform fraudulently

Suspension or termination may occur without a refund for the remaining membership period.

6. Intellectual Property

All content on the WINDMILL platform, including logos, text, images, and design, is our property or licensed to us. You may not:

  • Copy, reproduce, or distribute content without permission
  • Use our trademarks or logos without authorization
  • Create derivative works based on our content

7. Liability & Disclaimers

7.1 Platform "As-Is"

WINDMILL is provided "as-is" without warranties of any kind, express or implied. We do not guarantee:

  • Continuous, uninterrupted access
  • Absence of errors or bugs
  • Security against all threats

7.2 Limitation of Liability

To the maximum extent permitted by law, WINDMILL is not liable for:

  • Loss of data, income, or business opportunity
  • Indirect, incidental, special, or consequential damages
  • Issues arising from third-party services (Veriff, 2Checkout, Resend)
  • Venue-related incidents or third-party conduct

7.3 Indemnification

You agree to indemnify and hold WINDMILL harmless from any claims, damages, or costs arising from your violation of these Terms or misuse of the platform.

8. Privacy & Data

Your use of WINDMILL is governed by our Privacy Policy (windmillpassport.com/privacy), which is incorporated into these Terms by reference. By using WINDMILL, you consent to the collection and processing of your data as described in the Privacy Policy.

9. Third-Party Services

WINDMILL uses third-party services that are not under our control. WINDMILL is not responsible for:

  • Veriff's identity verification process or decisions
  • 2Checkout's payment processing or security
  • Venue partnerships, events, or third-party conduct

These third parties have their own terms and privacy policies. Please review them.

10. Governing Law & Jurisdiction

  • Governing Law: These Terms are governed by the laws of Albania
  • Dispute Resolution: Any disputes arising from these Terms or your use of WINDMILL will be resolved in the courts of Albania

Important Note: EU residents retain all consumer protection rights under EU law, including the right to dispute charges and seek remedies through local authorities, regardless of this choice of law provision.

11. Modifications to Terms

We may update these Terms at any time. Changes will be effective upon posting to windmillpassport.com. We will notify you of material changes by email. Continued use of WINDMILL after changes signifies acceptance.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WINDMILL regarding your use of our platform. Any previous agreements are superseded.

13. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be removed, and the remaining Terms will continue in full force.

14. Waiver

Our failure to enforce any right does not constitute a waiver of that right. We reserve all rights under these Terms.
